Terms of Service — Maple Paws Pet Services Ltd.

1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern the use of services provided by Maple Paws Pet Services Ltd. (the “Company,” “we,” “us,” or “our”). By booking, scheduling, paying for, or otherwise using any of our services, you (“Client,” “you,” or “your”) agree to be bound by these Terms, as well as any service-specific agreements, intake forms, pet profiles, policies, instructions, waivers, or consent forms provided by us from time to time.
If you do not agree to these Terms, you must not use our services. If you are booking services on behalf of another person or household, you represent and warrant that you have authority to accept these Terms on their behalf.
These Terms are intended to be read together with any booking confirmation, service plan, or written instructions provided by the Client and accepted by the Company. In the event of a conflict, the more specific written agreement or service confirmation will prevail to the extent of that conflict.
2. Scope of Services
Maple Paws Pet Services Ltd. provides pet-related services, which may include, subject to availability and suitability:
- Dog walking;
- Pet sitting;
- Grooming and bathing;
- Nail trimming;
- Puppy care visits; and
- Cat care visits.
All services are subject to scheduling availability, geographic service area limitations, staff qualifications, pet behavior, health status, and any other criteria determined by the Company in its reasonable discretion.
We do not provide veterinary services, boarding services unless expressly stated in writing, emergency medical services, or training services unless separately agreed in writing. Any advice or observations we provide regarding your pet are informational only and do not constitute veterinary, medical, or legal advice.
We may decline, suspend, modify, or discontinue services if, in our reasonable opinion, a pet is unsafe to handle, poses a risk to people, animals, property, or itself, or if the Client breaches these Terms or any related policy.
3. User Obligations and Responsibilities
You are responsible for ensuring that all information provided to us is accurate, complete, and kept up to date, including information regarding your pet’s:
- age, breed, size, temperament, and behavior;
- medical conditions, allergies, medications, and special needs;
- vaccination status, parasite prevention, and veterinary contact details;
- history of aggression, escape behavior, separation anxiety, or reactive tendencies; and
- feeding, exercise, grooming, and other care instructions.
You must disclose any material risks or issues that could affect the safe provision of services. You agree not to withhold information that may affect the health, welfare, or safety of your pet, our staff, third parties, or property.
You represent and warrant that:
- your pet is legally owned by you or you are otherwise authorized to request services for the pet;
- your pet is properly licensed, vaccinated, and in compliance with applicable municipal, provincial, and federal laws;
- your premises and pet are reasonably safe for the performance of services;
- you will provide timely access to your home, pet, and any equipment or supplies needed for the service; and
- you will ensure that keys, codes, alarm instructions, and access credentials provided to us are accurate and functional.
You are responsible for securing valuables, informing us of any hazards on your property, and ensuring pets are properly restrained when required. You agree to provide all necessary supplies unless we expressly agree otherwise, including leashes, waste bags, food, medication, grooming tools, and cleaning materials where applicable.
You acknowledge that animals may behave unpredictably. To the fullest extent permitted by law, you assume all risks associated with your pet’s behavior, including injury, illness, escape, property damage, or other loss arising from your pet’s condition or conduct, except to the extent caused by our gross negligence or wilful misconduct.
4. Payment Terms and Conditions
Fees for services will be communicated at the time of booking, in a quote, rate sheet, service plan, invoice, or other written confirmation. Unless otherwise agreed in writing, all fees are stated in Canadian dollars and are payable in accordance with the payment terms specified at booking or on the invoice.
We may require deposits, prepayment, or authorization of payment methods before commencing services. If payment is not received when due, we reserve the right to suspend or refuse service, cancel bookings, charge applicable late fees or administrative fees where permitted by law, and recover reasonable costs of collection.
You authorize us to charge your selected payment method for all amounts owing, including service fees, taxes, gratuities if selected, cancellation fees, late fees, additional time, emergency costs, and any other approved charges arising from your use of the services.
Unless expressly stated otherwise, fees do not include taxes, parking charges, tolls, travel surcharges, special handling charges, emergency veterinary transport costs, or other out-of-pocket expenses incurred in providing services. Where applicable, taxes will be added in accordance with Canadian law.
If a pet requires additional time, care, supplies, transport, or specialized handling beyond the original booking due to unanticipated circumstances, you agree to pay the reasonable additional charges associated with that service.
5. Cancellation and Refund Policy
Cancellations and rescheduling requests must be made in accordance with the cancellation policy communicated at booking or, if none is specified, within a reasonable time before the scheduled service. We may charge a cancellation fee for late cancellations, no-shows, or same-day changes, particularly where staff time, travel, or reserved capacity has been committed.
If we arrive at the service location and cannot complete the service due to the Client’s fault or omission, including lack of access, inaccurate instructions, unsafe conditions, or an unavailable pet, the booking may be treated as a late cancellation or no-show and charged in full or in part.
Refunds are generally issued only where required by law or where we determine, in our sole reasonable discretion, that a refund is appropriate. Where services have already been partially performed, any refund may be reduced by the value of services already rendered and any non-recoverable expenses incurred.
We may cancel or reschedule services due to weather, staffing, safety concerns, emergency situations, public health directives, or force majeure events. In such cases, we will make reasonable efforts to offer an alternative time or a credit, but we are not liable for consequential losses caused by such cancellation or rescheduling.
If any prepaid balance remains after cancellation, we may apply applicable cancellation fees, administrative fees, or completed service charges before issuing any remaining refund or credit.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Paws Pet Services Ltd., its directors, officers, employees, contractors, agents, and representatives shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profit, loss of revenue, loss of opportunity, emotional distress, or loss of data, arising out of or related to the services or these Terms, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or related to the services, whether in contract, tort, negligence, strict liability, or otherwise, shall not exceed the total amount paid by you to the Company for the specific service giving rise to the claim in the three (3) months preceding the event giving rise to the claim, or CAD $250, whichever is greater, except where such limitation is prohibited by law.
Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded or limited under applicable law, including applicable consumer protection legislation.
You agree to indemnify, defend, and hold harmless Maple Paws Pet Services Ltd. from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from:
- your breach of these Terms;
- your pet’s behavior, condition, or undisclosed characteristics;
- your failure to provide accurate instructions, safe premises, or required supplies;
- claims by third parties relating to your pet, property, or instructions; and
- your violation of any law or regulation.
You acknowledge that pet services involve inherent risks, including bites, scratches, slips, falls, allergic reactions, stress, illness, escape, injury, and property damage. You accept these risks to the extent permitted by law.
7. Intellectual Property Rights
All content, materials, text, graphics, logos, service names, website content, forms, photos, designs, templates, and other intellectual property used or provided by Maple Paws Pet Services Ltd. are owned by or licensed to the Company and are protected by applicable intellectual property laws in Canada and elsewhere.
You are granted a limited, non-exclusive, non-transferable, revocable license to use our materials solely for your personal use in connection with receiving our services. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit our intellectual property without our prior written consent.
Any feedback, suggestions, or ideas you submit to us may be used by the Company without restriction or compensation, subject to applicable law.
8. Data Protection and Privacy
We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including applicable provincial privacy legislation and, where applicable, the Personal Information Protection and Electronic Documents Act (“PIPEDA”).
By using our services, you consent to the collection, use, and disclosure of personal information necessary to:
- provide and manage services;
- process bookings and payments;
- communicate with you about appointments, service updates, and support;
- maintain pet care records and emergency contacts;
- comply with legal obligations; and
- protect the safety of pets, clients, staff, and the public.
We may share personal information with service providers, payment processors, veterinarians in emergencies, and other third parties where necessary to deliver services or where required by law. We will take reasonable administrative, technical, and physical safeguards to protect personal information, but no method of transmission or storage is completely secure.
You are responsible for obtaining any necessary consent from other household members, property owners, or authorized contacts whose information you provide to us. 9. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to acts of God, severe weather, fire, flood, earthquake, epidemic, pandemic, public health measures, labour disruptions, power outages, transportation failures, acts of war, civil unrest, governmental actions, cyber incidents, or failure of suppliers or third-party service providers.
During a force majeure event, we may suspend, reschedule, modify, or cancel services without liability, provided that we use reasonable efforts to communicate with you and mitigate disruption where practicable.
10. Changes to Terms
We may update or modify these Terms from time to time to reflect changes in our services, business practices, or applicable law. The revised Terms will be effective upon posting or upon the date stated in the updated version, whichever is earlier, unless otherwise required by law.
Your continued use of our services after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the services.
11. Applicable Law and Jurisdiction
These Terms, and any dispute, claim, or controversy arising out of or relating to them or the services, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
You agree that the courts located in Ontario, Canada shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the services, subject to any mandatory consumer rights or jurisdictional requirements under applicable law.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be interpreted, enforced, or limited to the minimum extent necessary so that the remaining provisions remain in full force and effect. If any provision cannot be so interpreted, it shall be severed, and the remainder of these Terms shall continue to be valid and enforceable.
No waiver by the Company of any breach or default shall be deemed a waiver of any preceding or subsequent breach or default. Our failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
By using the services of Maple Paws Pet Services Ltd., you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
